These Terms of Service ("Terms") govern your use of the HelmLog mobile application ("App") provided by Zeaspark ("we", "our", or "us"). By downloading or using HelmLog, you agree to these Terms.

1. Use of the App

HelmLog is a sailing and boating logbook application designed to help you record trips, track routes, manage boat maintenance, and monitor anchor positions. The App is provided "as is" for personal, non-commercial use.

2. Subscriptions

HelmLog Pro

HelmLog offers a free tier with basic functionality and an optional premium subscription ("HelmLog Pro") that unlocks additional features including unlimited trip history, multiple boats, all export formats, and unlimited maintenance logging.

Pricing and Billing

  • Subscription prices are displayed in the App and may vary by region.
  • Payment is charged to your Apple ID account at confirmation of purchase.
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.

Cancellation

  • You can manage or cancel your subscription at any time through your device's Settings > Apple ID > Subscriptions.
  • Cancellation takes effect at the end of the current billing period. You will retain access to premium features until that date.
  • No refunds are provided for partial billing periods.

Free Trial

  • If a free trial is offered, it will be clearly disclosed before purchase.
  • Any unused portion of a free trial is forfeited when you purchase a subscription.

Restore Purchases

  • You can restore previous purchases using the "Restore Purchases" button in the subscription screen.

3. Your Data

All data you create in HelmLog (trips, boats, crew, photos, maintenance records) is stored locally on your device. We do not store your data on external servers. You are responsible for maintaining backups of your data. See our Privacy Policy for details on how we handle your information.

4. Location Services

HelmLog uses your device's GPS to record trip routes, calculate speed and distance, and provide anchor alarm functionality. Location tracking only occurs when you explicitly start a trip or activate the anchor alarm. You can revoke location permissions at any time through your device settings.

5. Accuracy Disclaimer

HelmLog is a recreational logging tool and is not intended for navigation. GPS accuracy depends on your device, environmental conditions, and satellite availability. Trip statistics (speed, distance, heading) are approximate and should not be relied upon for navigation or safety-critical decisions. Always use proper marine navigation equipment and charts.

6. Anchor Alarm Disclaimer

The anchor alarm feature is provided as a convenience tool. It relies on GPS accuracy and device connectivity, which may be affected by environmental conditions, battery status, or device settings. The anchor alarm does not replace proper watch-keeping practices. You are solely responsible for the safety of your vessel and crew at all times.

7. Intellectual Property

HelmLog, including its design, code, and content, is the intellectual property of Zeaspark. You may not copy, modify, distribute, or reverse-engineer the App.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Zeaspark shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App. This includes, but is not limited to, damages resulting from inaccurate GPS data, anchor alarm failures, or data loss.

9. Termination

We may terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or our business.

10. Changes to These Terms

We may update these Terms from time to time. The updated version will be indicated by the "Last updated" date. Continued use of the App after changes constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the Netherlands, without regard to conflict of law provisions.
